Terms and Conditions

These terms govern access to and use of PopRuler, operated by The Boggler Inc. Please review them carefully before using the platform.

By accessing or using PopRuler, you agree to be bound by these Terms and Conditions. If you do not agree, do not use the platform.

1. Who We Are

PopRuler is a platform for communities, organizations, schools, and public groups to host discussions, collect submissions, run votes, and manage related participation features. References to "PopRuler," "we," "our," and "us" mean The Boggler Inc.

2. Eligibility and Accounts

You may use the platform only if you can form a legally binding agreement with us and comply with applicable law. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate information, keep your account details up to date, and notify us promptly if you believe your account has been accessed without authorization.

3. Acceptable Use

You agree not to misuse the platform. This includes, without limitation, doing any of the following:

  • Violating any law, regulation, or third-party right.
  • Impersonating another person or misrepresenting your affiliation.
  • Uploading unlawful, defamatory, harassing, fraudulent, or infringing content.
  • Interfering with platform security, stability, or normal operation.
  • Attempting to gain unauthorized access to accounts, data, or systems.
  • Using bots, scrapers, or automated methods except where expressly authorized by us in writing.
  • Reverse engineering, copying, reproducing, republishing, or commercially exploiting the platform except as permitted by law or by our written consent.

4. User Content

You retain ownership of content you submit, post, upload, or otherwise provide through the platform, including text, images, video, comments, and other materials ("User Content").

By submitting User Content, you grant The Boggler Inc. a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, adapt, and distribute that content only as needed to operate, improve, and provide the platform and related services.

You represent and warrant that you have the necessary rights to submit your User Content and that your User Content does not violate these Terms and Conditions or the rights of any third party.

5. Platform Ownership

The platform, including its software, design, layout, branding, workflows, interfaces, features, and all related intellectual property rights, is owned by The Boggler Inc. and protected by copyright, trademark, and other applicable laws.

Except for the limited right to use the platform under these Terms and Conditions, no rights are granted to you. All rights not expressly granted are reserved.

6. Paid Features, Tokens, and Transactions

Some features may involve payments, token balances, cash-outs, contest funding, or other financial functionality. If you use those features, you agree to provide accurate payment information and to comply with any additional terms presented at the time of transaction.

We may suspend, refuse, delay, or reverse transactions where necessary to address fraud, abuse, legal compliance, technical issues, or platform integrity concerns. Except where required by law, purchases and fees are non-refundable.

7. Community and Moderator Actions

Bubble owners, administrators, moderators, and similar organizers may create rules for their spaces, manage membership, remove submissions, and control access. We may also review, remove, restrict, or disable content or accounts if we reasonably believe doing so is necessary to protect users, enforce these Terms and Conditions, comply with law, or protect the platform.

8. Privacy

Your use of the platform is also subject to our Privacy Policy, which explains how we collect, use, and share personal information.

9. Third-Party Services

The platform may rely on or link to third-party services, such as payment processors, cloud hosting providers, authentication providers, and media services. We are not responsible for third-party services or content except as required by law, and your use of those services may be subject to their own terms and policies.

10. Disclaimer of Warranties

The platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, The Boggler Inc. disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that the platform will be uninterrupted, secure, error-free, or suitable for every purpose.

11. Limitation of Liability

To the fullest extent permitted by law, The Boggler Inc. and its officers, directors, employees, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities arising out of or related to your use of or inability to use the platform.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the platform or these Terms and Conditions will not exceed the greater of one hundred U.S. dollars (US $100) or the amount you paid us, if any, in the twelve months before the event giving rise to the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless The Boggler Inc. and its affiliates, officers, directors, employees, and agents from and against claims, liabilities, damages, losses, and expenses arising out of or relating to your User Content, your misuse of the platform, or your violation of these Terms and Conditions or applicable law.

13. Suspension and Termination

We may suspend or terminate your access to the platform at any time, with or without notice, if we believe you have violated these Terms and Conditions, created risk for other users or the platform, or where suspension is otherwise necessary for legal, security, or operational reasons.

You may stop using the platform at any time. Sections that by their nature should survive termination will survive, including sections relating to ownership, disclaimers, limitation of liability, indemnification, and dispute resolution.

14. Changes to the Platform or Terms

We may modify the platform, discontinue features, or update these Terms and Conditions from time to time. When we do, we will post the updated version on this page and update the "Last updated" date above. Your continued use of the platform after changes become effective means you accept the revised Terms and Conditions.

15. Governing Law

These Terms and Conditions are governed by the laws of the jurisdiction in which The Boggler Inc. is organized, without regard to conflict of laws principles, unless applicable law requires otherwise.
